At eyeclarity we respect and recognise the importance of your personal information and your privacy and its protection.

This page explains how we collect, use and safeguard your personal information. If you have any questions relating to this policy, please contact us.


What Personal Information Do We Hold?

We may collect the following types of personal information:

We are required to collect your name, address and date of birth as part of our legal and regulatory obligations, including under the Health Practitioner Regulation National Law as enacted in each state and territory of Australia and Health Practitioners Competence Assurance Act 2003.

How do we collect personal information

eyeclarity will collect personal information directly from you unless it is not reasonably practicable to do so. We will only ask you to provide information that is relevant to the service or product that you have requested or to enable us to respond to your enquiry. We may collect personal information from you in various ways including:

  • when you visit an eyeclarity store for an eye examination or to purchase products including sunglasses, frames, lenses or contact lenses) and other associated products and services;
  • when you attend a vision screening organised by eyeclarity at a public or industry event or a vision screening organised by your employer;
  • when you visit an eyeclarity store or our website or indirectly through the use of our website or online presences, through our representatives or otherwise;
  • when you book an eye examination or make an enquiry over the phone, through our website or other electronic means;
  • when you enter our competitions and trade promotions;
  • when you register on our website;
  • when you contact us via our social media pages (such as Facebook, Twitter or Instagram);
  • when you apply for a job with us, our suppliers or contractors;
  • when you provide customer feedback surveys, lodge a complaint and communicate with our customer service opfficers.
  • when authorised people provide us with your personal information on your behalf

Your personal information may also be collected on occasions through third parties including:

  • from employment recruitment agencies;
  • from health funds or Government agency (in order to receive advice about your eligibility to rebates on eyeclarity eyecare services and eyewear products);
  • from other optometrists and health practitioners (with your consent);

When you use our website, we may use aggregated, anonymous analytic tracking via a third party to gather information about the way the website is used. In some cases we may also collect your personal information through the use of cookies. eyeclarity collects personal information about you so that we can provide you with the most appropriate eye care and eye wear products and services, and to provide you with a high quality of customer service.

  • to provide products and services to you and to send communications to you;
  • to provide products and services to you as a result of a contractual arrangement with your employer;
  • to answer enquiries and provide information or advice about existing and new products or services;
  • to advise you on your eye care needs including when it’s time to come and see us for another eye test;
  • advise you if we relocate;
  • advise you if your store changes ;
  • to assess the performance of the website and to improve the operation of the website;
  • to assess our customer service and to improve our customer service to you;
  • to conduct general administrative and business purposes
  • undertaking direct marketing such as providing information to you about special offers, promotions, products or services that we think may be of interest to you or conducting market research surveys including by mail, email, SMS or other forms of communication.  When we send you direct marketing materials about our products and services, you will be able to unsubscribe from them;
  • for the administrative, marketing (including direct marketing and marketing research), planning, product or service development, quality control, human resources, educational and research purposes of eyeclarity its related bodies corporate, contractors or service providers;
  • to provide your updated personal information to our related bodies corporate, , contractors or service providers;
  • to update our records and keep your contact details up to date;
  • to process and respond to any complaint or enquiry made by you; and
  • to comply with any law, rule, regulation, lawful and binding determination, decision or direction of a regulator, or in co-operation with any governmental authority of any country.

We may also collect personal information about third parties from you, such as personal information about your family members, so that we can provide products and services to those third parties. If you provide personal information about a third party individual to us, you must ensure that the third party individual is aware of this Privacy Policy, understands it and agrees to accept it. If you provide personal information about a third party individual and that individual does not have the capacity to understand and agree to these terms (for example, a minor), we require a parent or guardian to acknowledge and agree to this paragraph.

How May We Disclose You Infomation?

There may be times when we need to disclose your personal information to third parties (some of which may be based outside Australia). eyeclarity shall take such steps as are reasonable in the circumstances to ensure the information is de-identified prior to disclosure. eyelcarity will only disclose your information to:

  • persons to whom we may be required to pass your information by law including regulatory bodies;
  • persons assisting eyeclarity to protect and defend the rights of eyeclarity, the interests and personal safety of users of eyeclarity.com.au ,customers of eyeclarity or members of the public; 
  • service providers such as organisations who provide data processing, customer satisfaction surveys, printing and fulfilment operations who may be located in the other countries.
    • anyone authorised by the individual to whom the personal information relates to;
    • to another company or business where our store or stores are acquired by, sold to or otherwise transferred to that company or business; with your consent, to other health practitioners and medical practitioners and forward relevant information to that health practitioner or medical practitioner about your particular condition; and

We may disclose your personal information to our related bodies corporate and third party suppliers and service providers, government and quasi-government organisations, prospective purchasers of part of or the whole of our business located overseas for some of the purposes listed above. We take reasonable steps to ensure that the overseas recipients of your personal information do not breach the privacy obligations relating to your personal information.

We may disclose your personal information to entities located outside of Australia.

Security Of Personal Information

eyeclarity has security safeguards and procedures in place to ensure that the personal information we collect is stored in a secure environment protected from unauthorised access, modification or disclosure.

Although we take reasonable steps to maintain the security of our internet connections, for reasons outside of our control, information transmitted to us over the internet may not be absolutely secure. eyeclarity and related entities assumes no responsibility for disclosure of data due to errors in transmission.

Whilst we will use our all reasonable endeavours to safeguard your person information we cannot guarantee that your personal information will be protected against unauthorised access, misuse or disclosure. We do not accept any liability for the improper actions of unauthorised third parties. 

eyeclarity and related entities also assumes no responsibility or liability for third parties such as advertisers or other entities who utilise banner ads and links from our website. If you click through a banner ad or link and submit your information to an advertiser, you will be subject to the privacy policies of that party.

eyeclarity ensures that all employees and contractors are bound by a confidentiality agreement requiring that they do not  use or disclose your personal information in a manner contrary to this Privacy Policy.

We retain your personal information in line with relevant legislation and for as long as the information is relevant to our business purposes as set out above or until you request that we remove the information by contacting your local eyeclarity store. 

eyeclarity has procedures in place to ensure that any document or record containing your personal or health information is disposed of in a manner that preserves your privacy.
 

Disclaimer

We take precautions to protect your personal information collected through eyeclarity.com.au but in the event that our system is infiltrated by unauthorised third parties we will not be liable for any resulting misuse of the personal information.

Updating Your Personal Information 

eyeclarity endeavours to ensure that the personal information it holds about individuals is accurate, complete up-to-date and not misleading. Please contact your local eyeclarity store if the information we hold about you requires changing, or is out of date. If it is reasonable in the circumstances for us to do so, we will make the requested change or correction, otherwise we will take reasonable steps to record the substance of your change or correction request.

Accessing Personal Information 

You will be able to access personal information that eyeclarity holds about you if it can be readily retrieved, subject to some exceptions allowed by law.

To request access to your personal information please contact your local eyeclarity store in writing.

To the extent permitted by law eyeclarity may charge a reasonable administrative fee associated with providing a copy of your personal information to you.
